Intellectual Property in Tough Tech Ventures

Abstract
This note explains the crucial role of intellectual property rights (IPR), particularly patents, in the success of tough tech ventures (TTVs). It outlines the patent system's mechanics, emphasizing utility patents and their requirements for novelty, non-obviousness, and enablement. The note details various IP strategies for TTVs, including licensing, patent-paper pairs, and platform models. The note also discusses best practices for conducting freedom-to-operate searches, choosing patents vs. trade secrets, negotiating licensing deals, and setting up intellectual property practices for growing startups. Numerous examples from various industries illustrate these concepts.
